Lieutenant De Bathe resigned from the Australian Army and accepted a Commission in the British Army on 28 October 1915.
On 4 November 1918, Lieutenant De Bathe was killed in the crash Avro 504 aircraft D8916 after it collided in the air with BE2 aircraft 8409 flown by Captain Hugh Sutherland RAF who also was killed. Cadet James Hops RAF flying under instruction in 8409 was slightly injured.
